Preamble:
FCS Frankfurt Cargo Services GmbH (“FCS”) is the largest airline-independent cargo handling company at Frankfurt Airport and for about 50 years has been a top provider when it comes to transporting airfreight quickly and securely to and from Frankfurt. FCS wishes to assume responsibility from an ethical, social, and economic standpoint as well as toward the environment. We expect our suppliers and service providers (“business partners”) to comply with the principles set down in this code of conduct on a binding basis.

 

 

 

 

 

 

 

1.    Compliance with laws, recognized standards, and guidelines:
All applicable national laws and relevant internationally recognized standards, guidelines, and principles must be complied with.

2.    Prevention of corruption:
The relevant provisions of law on fighting corruption must be observed.

3.    Antitrust law and law of competition:
FCS expects its business partners to comply with all applicable national and international antitrust laws and the laws against unfair competition.

4.    Occupational safety and health:
All business partners must take care to ensure a safe, healthy, and hygienic work environment and take the necessary measures to prevent accidents and harmful health effects.

5.    Working hours:
Working hours must be in keeping with applicable law or the relevant ILO conventions.

6.    Compensation:
The business partner is obligated, for the entire term of execution of the contract, to grant those of its employees who are involved therein the payments that apply to them by law or based on a collective agreement as determined by law.

7.    Freedom of association and collective bargaining rights:
The rights of all employees to freedom of association and collective bargaining must be upheld and protected against adverse effects.

8.    Handling of child labor:
There is zero tolerance for exploitation of children and/or teens. Child labor is prohibited.

9.    Handling of forced labor:
All forms of forced or compulsory labor are strictly prohibited, as is involuntary prison labor in violation of human rights.

10.    Disciplinary measures:
All employees must be treated with dignity and respect. Sanctions, fines, other punishments, and disciplinary measures must be imposed only in accordance with applicable national and international standards and the internationally recognized human rights.

11.    Handling of discrimination:
All forms of discrimination are strictly prohibited.

12.    Protecting the environment and the climate:
FCS expects its business partners to observe environmental protection with an eye to applicable international standards and legal provisions.

i.    Implementation:
We expect our business partners to uphold the principles stated above.

ii.    Information and communication:
Business partners are urged to make the provisions of this code of conduct accessible to all employees.

iii.    Monitoring:
FCS reserves the right to verify compliance with the requirements stated above, either through FCS itself or through independent third parties.

iv.    Sanctions and corrective action:
All serious violations of the obligations mentioned in this code of conduct will be viewed as significant breaches of contract on the business partner’s part and will be assessed from a legal standpoint in each individual case.

We are not bound to any airline or shipping company and act as a neutral service partner, supporting our customers’ business with customized full-service packages and demand-driven additional services for physical and documentary handling of import and export consignments at absolutely competitive prices.

In keeping with our basic values of honesty, integrity, trustworthiness, responsibility, transparency, and fairness, we set and apply the very highest standards in order to do business in a manner that is compatible with the future in social, economic, and environmental terms. We view sustainability as stewardship to help shape a better future. We have defined this responsibility in a code of conduct for our employees.
We expect our suppliers and service providers to comply with the same standards. This code of conduct describes the standards for business relations with the companies that are shareholders in FCS. It applies to all suppliers and service providers with whom there are direct business relations (hereinafter “business partners”).

Compliance

1.    Compliance with laws, recognized standards, and guidelines
Each business partner is required to comply with the applicable national laws and to support the relevant internationally recognized standards, guidelines, and principles, especially the principles of the UN Global Compact, the Universal Declaration of Human Rights, the United Nations (UN) conventions, and the Declaration on Fundamental Principles and Rights at Work of the International Labour Organization (ILO) as well as the OECD Guidelines for Multinational Enterprises.

Compliance with this code of conduct and the standards detailed above must not be circumvented by side agreements or understandings, such as contracts or agreements or comparable measures.

2.    Prevention of corruption
The business partner denounces corruption and bribery and stands for compliance with international and local laws to prevent and fight corruption and bribery. The business partner affirms that it will not offer, promise, or grant any impermissible benefits or perquisites to employees of FCS in order to influence their decisions.

3.    Antitrust law and law of competition
The business partner must observe all applicable national and international antitrust laws and the laws against unfair competition. Agreements on pricing or terms with competitors are prohibited, as are other anticompetitive arrangements, which include, in particular, agreements with competitors for the purpose of allocating shares of any market or allocating customers.


Working conditions

4.    Occupational safety and health
FCS is committed to preventing accidents and illnesses in the workplace. This helps to ensure employee well-being and satisfaction while also making a crucial contribution to a company’s success.

We expect our business partners to ensure a safe, healthy, and hygienic working environment and to take the necessary actions to prevent accidents and adverse health effects that may arise in connection with employees’ activities. Care must be taken to ensure that occupational safety standards are upheld. Business partners must take suitable action to ensure this and must maintain systems to identify and prevent potential health risks due to accidents, injuries, and work-related illness among their employees.

5.    Working hours
Working hours must be in keeping with the applicable national laws and regulations or the relevant ILO conventions.

6.    Compensation
The business partner is obligated, for the entire term of execution of the contract, to grant those of its employees who are involved therein the payments that apply to them by law or based on a collective agreement as determined by law.

Human rights

7.    Freedom of association and collective bargaining rights
The business partner must respect the fundamental right of freedom of association and the right to collective bargaining within the scope of the national laws.
In the event that domestic laws or regulations restrict freedom of association and/or collective bargaining rights, the business partner should work to ensure that free and independent association of employees for purposes of negotiation is made possible and permitted.


8.    Handling of child labor
There is zero tolerance for exploitation of children and/or teens. Child labor as defined in the ILO conventions and national provisions is prohibited.

The age limit for permissible employment must not be below the age up to which children are required to attend school, and in no case under 15 years (or 14 years, where permitted by national law in compliance with ILO Convention 138).

Teens must not be exposed to any situations that are dangerous, unsafe, or harmful to their health.

9.    Forced labor
The supplier must refrain from engaging in any form whatsoever of forced labor. All forms of forced or compulsory labor are strictly prohibited, as is involuntary prison labor in violation of human rights.

10.    Disciplinary measures
FCS firmly believes all employees should be treated with dignity and respect. Sanctions, fines, other punishments, and disciplinary measures must be imposed only in accordance with applicable national and international standards and the internationally recognized human rights.

The business partner must take appropriate action to ensure that no employee faces verbal, psychological, sexual, and/or physical violence, coercion, or harassment.

11.    Handling of discrimination
The business partner must refrain from engaging in any form of discrimination based on the following or other personal characteristics:
-    Ethnic, national or social origin
-    Race
-    Skin color
-    Gender or sex
-    Age
-    Religion and worldview
-    Political activities
-    Membership in an employee organization
-    Disability
-    Sexual orientation
 The relevant statutory provisions apply.

Environment

12.    Protecting the environment and the climate
FCS expects its business partners to observe environmental protection with an eye to applicable international standards and legal provisions, minimize environmental impact, and achieve continuous improvement in their efforts to protect the environment and the climate. This includes preventing emissions and waste and taking steps to improve resource efficiency. To this end, suitable and understandable measures must be taken and systems maintained to ensure the protection of the environment and the climate.

Final provisions

i.    Implementation
We expect our business partners to uphold the principles stated above.
FCS recommends that a suitable system (definition and documentation of responsibilities, processes, targets, and measures) be used to enable continuous improvement.
FCS expects its business partners to work to ensure that these standards are adopted consistently throughout the supply chain.

ii.    Information and communication
This code of conduct can be viewed online at http://www.fcs.wfs.aero/index.php/en/company/compliance-values-management at any time and printed from there. The business partner should make it available to the relevant employees.

iii.    Monitoring
Where applicable, business partners agree to permit relevant monitoring and checks to be performed and to provide appropriate support for this.

iv.    Sanctions and corrective action
FCS will view all serious violations of the obligations mentioned above as breach of contract on the business partner’s part and assess the matter from a legal standpoint in each individual case.
If possible, we will give the business partner the opportunity to take appropriate corrective action.
